A mistake made by many people going through a divorce is hiring the wrong lawyer. In fact, many people change lawyers in the middle of a divorce despite the added expense. With some thoughtful preparation, you can avoid this costly mistake at the onset.
To begin finding a good lawyer, ask trusted friends and family for recommendations and search online. Make sure you are looking at lawyers who focus their practice on family law. Once you have a list of names, see if there are reviews for those lawyers. A good lawyer will have many good reviews and a proven track record of success for their clients.
When you have narrowed down your list to a few lawyers you are interested in, schedule consultations with each one. Most lawyers offer free initial consultations, but some will charge a fee. Come prepared with a list of questions you would like answered. This is your chance to find out what type of approach the lawyer uses and what he/she recommends for your case, the fees you will be expected to pay, and who else in the firm may be working on your case. It is also your chance to assess if you feel comfortable working with this person, i.e. telling them every aspect of your married life, good, bad and ugly. A good attorney/client relationship depends on mutual open lines of communication. A good lawyer will listen to you and your concerns, not lecture or intimidate you. He/she will also deliver bad news with honesty, not only tell you what you want to hear.
A big consideration for hiring a divorce lawyer is style. Make sure you know what kind of divorce you are aiming for. If you are hoping to use mediation or a collaborative approach, then hiring a lawyer known for their aggressive reputation is not going to help you achieve that. However, if you are divorcing an unreasonable and antagonistic spouse, then you may need a tough lawyer who will stand up for you in court. If you know your divorce cannot be settled without going to trial, make sure you hire a lawyer with substantial courtroom experience.
If you are considering a divorce or feel one may be on the horizon, it is a good idea to identify a lawyer you want to work with before the need becomes urgent. Under the pressure to file, or once you have been served with divorce papers is a less than ideal situation for finding someone to represent you.
