Eric Marcy Article on Alec Baldwin’s Rust Shooting Published to NorthJersey.com

Eric Marcy, chair of the criminal and administrative law practices at Lyons & Associates, P.C., lent his views on Alec Baldwin’s legal liability for the fatal film set shooting in an article on NorthJersey.com. Eric’s piece, published on January 26, 2023, reacts to Baldwin’s indictment of involuntary manslaughter for the 2021 shooting death of cinematographer Halyna Hutchins on the set of Rust.

Among the issues Eric addresses are whether actors are criminally responsible for confirming if a set gun contains live rounds; if actors can rely on trained staff to ensure that a gun does not contain live rounds; and if actors should be trained to determine if a gun contains real bullets or blanks. Eric also discusses whether verbal assurances by armorer or production staff are adequate before an actor pulls the trigger, and how this case will affect Hollywood if it imposes strict liability anytime someone is killed by a firearm on a movie set.
